A man was charged with driving under the influence in Yellowstone County Justice Court on Friday.
Benjamin Joseph Wilke, 32, appeared in front of Justice of the Peace Pedro Hernandez and was charged with driving a motor vehicle under the influence of alcohol or drugs. Wilke’s record showed he has four prior DUI convictions in the past 15 years.
Wilke is being held in lieu of a $5,000 bond, and, should he post that, he must submit to 24/7 alcohol monitoring.
According to court documents, Wilke was arrested near the intersection of Interstate 90 and the South Billings Boulevard on-ramp in Billings on Oct. 8.
Two vehicles had crashed, and the man Wilke hit believed Wilke to be intoxicated because he kept falling asleep. Wilke complied with officers and gave them a breath sample, which showed a blood alcohol content of 0.117 percent.
